Terms & Conditions
1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of the AskForOne website (the "Site") and any related communications or services offered by Quan Nguyen (DRE #01966064), a licensed California real estate salesperson, brokered by Dalton Wade Inc. By using the Site or contacting us, you agree to these Terms. If you do not agree, please do not use the Site.
2. Real Estate Services & Brokerage
All real estate brokerage services are provided through Dalton Wade Inc., a licensed California real estate brokerage. Quan Nguyen is a licensed salesperson affiliated with Dalton Wade Inc. and is not an independent broker. Any agency relationship between you and Quan or the brokerage is created only by a written agreement signed by all parties.
3. No Agency by Inquiry
Submitting a valuation request, contact form, email, text, or phone call does not create an agency, fiduciary, or client relationship. You become a client only upon execution of a written listing agreement, buyer representation agreement, or similar engagement document.
4. Information & Valuations
Any home valuations, market estimates, savings comparisons, neighborhood data, or other information provided through the Site or in initial consultations are provided for informational purposes only. They are estimates based on available data, not appraisals, and they are not a guarantee of sale price, marketing time, or financial outcome.
Property listings, prices, square footage, and neighborhood information are believed to be accurate but are not warranted. Buyers and sellers should independently verify all information material to a transaction.
5. 1% Listing Fee
References to a "1% listing fee" describe the listing-side commission charged by Quan Nguyen for full-service representation when you sign a listing agreement under the standard program. All commissions are negotiable. Fees, terms, and any savings examples are summarized for marketing purposes; the binding terms are those set forth in your executed listing agreement.
6. Fees & Third-Party Services
The 1% listing fee covers the seller-side representation: pricing strategy, marketing, negotiation, and transaction management through close.
Optional services — including but not limited to professional staging, premium photography, video, drone, 3D tours, and other production-grade media — are not included in the 1% fee. These services are billed separately and paid directly to the chosen third-party vendor, and will only be engaged with the seller's written approval of scope and cost before any work begins.
Any buyer-side commission is not set in the listing agreement. It is typically raised by the buyer's agent when offers are submitted to the seller, and is open to discussion between the seller and the buyer at that time. Any buyer-side compensation ultimately agreed to is in addition to the 1% listing fee.
7. Intellectual Property
All content on the Site, including text, graphics, photographs, logos, and the "AskForOne" name and mark, is owned by or licensed to Quan Nguyen and Dalton Wade Inc. and is protected by copyright, trademark, and other laws. You may view and share the Site for your personal, non-commercial use. You may not copy, reproduce, republish, or use the content for commercial purposes without our prior written permission.
8. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information;
- Use the Site to send spam, harvest contact information, or interfere with other users;
- Attempt to gain unauthorized access to the Site, its servers, or any data;
- Use automated tools to scrape or copy content;
- Use the Site for any unlawful purpose or in violation of these Terms.
9. Third-Party Links
The Site may contain links to third-party websites (such as MLS listings, mapping providers, or social media). We are not responsible for the content, policies, or practices of those sites. Accessing third-party sites is at your own risk.
10. Disclaimers
The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the fullest extent permitted by law, Quan Nguyen, Dalton Wade Inc., and their affiliates, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or any information obtained from it. Our total aggregate liability arising out of your use of the Site will not exceed one hundred US dollars (US $100). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability under our executed real estate agreements.
12. Equal Housing Opportunity
We are committed to the letter and spirit of US policy for the achievement of equal housing opportunity. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, familial status, national origin, ancestry, source of income, disability, or any other protected category.
13. Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
